Terms of Use

These Terms of Use (hereinafter referred to as the “Terms”) set forth the terms and conditions for using the online store (hereinafter referred to as the “Service”) operated by DC Shonan Co., Ltd. (hereinafter referred to as the “Company”). Users shall use the Service upon agreeing to these Terms.

Article 1 (Application)

  1. These Terms apply to all relationships between the Company and Users regarding the use of this Service.

  2. In addition to these Terms of Service, we may establish other policies regarding this Service, including delivery policies, return and refund policies, and disclosures required under the Act on Specified Commercial Transactions (hereinafter referred to as the “Policies”). The Policies constitute a part of these Terms of Service.

  3. In the event of any conflict between these Terms of Service and our various policies, the policies shall take precedence.

Article 2 (Use)

  1. Users may use this service regardless of whether they are registered members (unless otherwise specified by us).

  2. Users are required to provide accurate information (such as their name, address, and contact details) when placing orders or making inquiries.

Article 3 (Conclusion of the Sales Contract)

  1. Under this service, a sales contract is formed when the user completes the purchase process and we send an order confirmation.

  2. We reserve the right to cancel an order even after the contract has been concluded in the event of stock shortages, payment failures, suspected fraudulent activity, inability to deliver, or other reasonable grounds.

Article 4 (Prices and Payment)

  1. The product price shall be the price displayed on each product page.

  2. Payment methods include Shopify Payments (Visa, Mastercard, American Express, Apple Pay, Google Pay, and Shop Pay) and Amazon Pay, among others, as specified by us.

  3. Payment is processed at the time of purchase (the billing date varies depending on the credit card company or payment processor).

Article 5 (Delivery and Shipping Fees)

  1. Domestic shipping rates are generally as follows.

    • Honshu, Shikoku, and Kyushu: Free

    • Hokkaido: 1,710 yen (tax included)

    • Okinawa: 1,810 yen (tax included)

  2. As a general rule, international shipments are sent via EMS, and the flat-rate shipping fee (up to 3 kg via EMS) for each country is displayed on the checkout screen.

  3. We cannot ship orders weighing more than 3 kg.

  4. Some products, such as liquids and adhesives, cannot be shipped internationally (domestic shipping only).

Article 6 (Cancellations, Returns, and Exchanges)

  1. For cancellations made at the customer's request, we generally charge the following cancellation fees.

    • Wetsuits: 90% of the purchase price

    • Other items: 30% of the item price

  2. As a general rule, we do not accept returns or exchanges for reasons attributable to the customer.

  3. If you receive a defective item or the wrong item, please contact us within 7 days of delivery. Provided the item is unused and the tags and packaging are intact, we will arrange for an exchange or refund, and we will cover the return shipping costs.

  4. We cannot accept exchanges after the item has been worn or used in water.

Article 7 (Customs Duties and Import Taxes on International Shipments)

For international shipments, customs duties, import taxes, and customs clearance fees may apply. If these charges are incurred, they will be the responsibility of the recipient (purchaser).

Article 8 (Prohibited Acts)

When using this Service, users must not engage in the following acts:
(1) Acts that violate laws, regulations, or public order and morals
(2) Unauthorized access or acts that interfere with the system
(3) Acts that infringe upon the intellectual property rights of the Company or third parties
(4) Acts involving the registration or transmission of false information
(5) Any other acts that the Company deems inappropriate

Article 9 (Intellectual Property Rights)

All rights to the content on this service, including photographs, text, and designs, belong to our company or the respective rights holders. You may not reproduce, reprint, modify, or otherwise use this content without the rights holder’s permission.

Article 10 (Disclaimer)

  1. We do not guarantee that this Service is free from factual or legal defects.

  2. Except in cases of willful misconduct or gross negligence on our part, we shall not be liable for any damages arising from the use of this Service.

  3. If liability is limited under the Consumer Contract Act or other mandatory laws, we will comply with such laws.

Article 11 (Modification or Suspension of the Service)

We may change the content of this service or suspend its provision without prior notice to users.

Article 12 (Amendments to the Terms and Conditions)

We reserve the right to modify these Terms at any time. By continuing to use the Service after any such changes, you agree to the modified Terms.

Article 13 (Governing Law and Jurisdiction)

  1. These Terms and Conditions shall be governed by the laws of Japan.

  2. In the event of any dispute arising from this Service, the court having jurisdiction over our place of business shall have exclusive jurisdiction in the first instance. However, if consumer protection laws or other regulations provide otherwise, such provisions shall prevail.
